Affiliate Disclosure
Effective Date: 05/30/2025
Welcome to the MarketingAid Affiliate Network. At MarketingAid Solutions FL, LLC (hereafter referred to as “MarketingAid,” “we,” “us,” or “our”), transparency and integrity are at the core of our operations. As such, we believe it is both ethically and legally essential to provide our customers, partners, and website visitors with a full and professional disclosure of how our affiliate relationships operate. This Affiliate Disclosure outlines our affiliations, the compensation structure we maintain, and the responsibilities expected of all affiliate participants. By participating in or engaging with our affiliate content, you agree to the terms outlined below.
1. Overview of Affiliate Relationships
MarketingAid operates an affiliate and reseller program, known publicly as the MarketingAid Affiliate Network. This program allows individuals and organizations (“Affiliates”) to promote our branded marketing solutions and receive compensation for resulting sales. These relationships are performance-based and designed to reward individuals who contribute to our brand’s growth and success.
All affiliates are required to adhere strictly to our marketing standards, ensure accurate representation of our offerings, and comply with Federal Trade Commission (FTC) regulations and other applicable legal standards.
2. Nature of Compensation
Affiliates are compensated through a combination of flat commissions and recurring revenue share, depending on the specific branded solution sold and the structure of the affiliate’s agreement. Additional performance-based incentives, bonuses, or promotional perks may be extended to high-performing affiliates at MarketingAid’s sole discretion.
It is important to note that any links or referral mechanisms provided to affiliates may result in a financial benefit to the affiliate. While not every recommendation or shared resource on our platform or by our partners is made with financial intent, when such compensation exists, we disclose it in accordance with FTC guidelines.
3. FTC Compliance and Ethical Disclosure
MarketingAid requires that all affiliates clearly disclose their relationship with us when promoting or discussing our products or services. This is not merely a best practice—it is a legal requirement.
Affiliates must state clearly and conspicuously that they receive compensation for referrals, whether in the form of a banner advertisement, direct link, or written recommendation. Phrases such as “I earn commissions for purchases made through this link” or “As a MarketingAid affiliate, I may receive compensation if you sign up” are acceptable examples.
Failure to disclose affiliate status properly may result in immediate termination from the MarketingAid Affiliate Network and possible legal consequences under applicable FTC guidelines.
4. Accuracy of Representations
Affiliates are responsible for representing MarketingAid’s services and branded solutions truthfully and accurately. Misleading statements, exaggerated claims, or any form of misrepresentation is strictly prohibited.
All promotional materials used by affiliates must be pre-approved or provided directly by MarketingAid. Affiliates may not create branded content, use copyrighted materials (including logos, product names, or proprietary graphics) without written permission, or claim to represent MarketingAid officially beyond their affiliate status.
5. Permitted Channels and Branding Guidelines
Affiliates are permitted to promote our solutions through their own websites, social media channels, email campaigns (with prior opt-in consent from recipients), blog content, and other online or offline methods, so long as these methods comply with our brand guidelines and applicable laws.
Affiliates may position our offerings as part of their own value stack (e.g., consultants or marketing agencies reselling MarketingAid solutions). However, they may not use our official branded product names (Clarivue, Adivra, Socierra, Cirqlia) in a misleading way or suggest direct ownership of these brands.
6. Earnings Disclaimer
Any examples or statements regarding potential earnings derived through the affiliate program are not guarantees. Actual earnings will vary based on market conditions, audience quality, compliance, and the affiliate’s own efforts.
MarketingAid makes no representation that any affiliate will achieve any level of success, income, or performance. We encourage all affiliates to conduct their own due diligence before engaging in promotional activities.
7. Use of Tracking Technology
MarketingAid uses tracking tools, including unique URLs, cookies, and platform integrations to ensure affiliates are properly credited for sales and conversions. These technologies may collect data such as IP addresses, timestamps, user behavior, and referral sources.
Our tracking mechanisms are designed to be secure, compliant with data protection laws (including GDPR and CCPA), and to ensure accuracy in attribution. However, affiliates are responsible for making visitors aware of these technologies via proper disclosures on their own platforms, where applicable.
8. Affiliate Obligations and Termination
Affiliates must remain in good standing by adhering to all MarketingAid policies, maintaining an ethical online presence, and meeting performance standards outlined in their agreement.
MarketingAid reserves the right to revoke, suspend, or terminate any affiliate account at any time, with or without notice, for violations of these terms, including:
● Misrepresentation of services
● Failure to disclose affiliate status
● Use of misleading or unethical marketing tactics
● Breach of intellectual property rights
● Conduct that could harm the reputation of MarketingAid
9. Jurisdiction and Governing Law
All affiliate relationships shall be governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes arising out of this Affiliate Disclosure or affiliate activities shall be resolved exclusively in the courts located in Florida.
10. Revisions and Updates
MarketingAid may update this Affiliate Disclosure at any time. Updates will be posted on our website with a revised effective date. We encourage all affiliates to review the disclosure periodically to stay informed about their responsibilities and obligations.
